Lenders Terms and Conditions
By visiting our website and/or renting an item from The 105, you are entering into a legal agreement and bound by these terms and conditions. We kindly recommend and ask that you review our Terms of Service prior to renting from us. These terms and conditions apply to all users of the site. We reserve the right to change the terms of this agreement in the future and any changes will apply.
If you do not agree to all of the terms and conditions of this agreement, then you may not access the website or use any services.
1. Prices and Modifications to the products
(i) Prices (with VAT & cleaning) are per unit and may vary depending on the style, brand and material of each garment.Â
(ii) The price of the required product can be seen on the dress price tag in our showroom and shall also be displayed on our website.Â
(iii) We reserve the right to modify the prices of our items at any time. We shall not be liable to you or any third-party for any modification, price change, suspension or discontinuance of the Service.Â
(iv) Prices for our products are subject to change without notice. However, modifications to price during a period where someone has already placed a booking and made a payment will not affect that rental price.
2. Booking Policy
(i) The customer can reserve their item/s from the showroom and a 50% deposit fee shall be requested upon booking and the balance to be paid upon collection.Â
(ii) The website will be continually modified to display availability of items and updated regularly to display new stock.Â
(iii) Customers may book appointments via our website.
(iv) If a dress has been loaned out for promotional reasons/PR loan/complimentary rental, all stated terms and conditions are still binding. The borrower will be responsible for the cost of any damage incurred whilst the items are in your possession.
3. Collection and Returning Policy
(i) Collection and Returning of items must be pre-arranged 24 hours in advance.
4. Returns and Late Return Fee Policy
(i) Please be mindful that our garments may be reserved by other customers and so would respectfully insist that returns arrive on time, otherwise a minimum late fee will apply of €25 per day.Â
(ii) In relation to items that are not returned, we shall have no option but to demand the replacement cost in full, as is our legal right.
(iii) We kindly ask that you return your item on the hanger and in the reusable garment bag provided by ‘The 105’.
5. Cleaning and Care Policy:Â
(i) The 105 fees include professional cleaning of all garments prior to rental and as such ask that customers do not attempt to wash or have our products dry cleaned as this could result in a surcharge.
(ii) In the event that a product is returned beyond ‘reasonable wear and tear’ then you agree that we can charge you for the cost of repairing or replacing the item as mentioned in the damage fees section.Â
(iii) Please do not iron, use safety pins nor sticky tape that will incur damage to garments.Â
(iv) The 105 would greatly appreciate it if all forms of fake tan are completely dry before wearing the garment and that customers refrain from spraying perfume directly onto the item which could lead to discoloration.
(v) We would really appreciate it if you could come with minimal makeup and tan to your try-on appointment to avoid staining dry cleaned items.Â
(vi) It is imperative that the item is returned in the same condition as given and the borrower is liable for all damage costs.Â
6. Damage/Loss fee
(i) I agree that if any part of the product is permanently damaged, I will be fully responsible for the cost of repair (this will be done by the 105) and I could be liable for any or all costs of replacement of the item and that this will be charged to my credit card. You will be given an option to keep the product once full retail cost is paid.Â
(ii) PLEASE inform us as soon as possible if anything happens to the garment so that we can prepare for urgent repairs.
(iii) In the event of returning an item damaged, we reserve the right to charge for the cost of repair plus the daily rental for as long as the item is unavailable to rent or if deemed irreparable the RRP of replacement will be incurred. Each case will be evaluated individually.Â
7. Cancellation Policy
(i) Cancellation of an order must be made 3 days (72 hours) prior to your rental start date and failure to do so shall incur the full cost of rental.Â
8. Billing’
(i) When renting an item from ‘The 105’, you will be required to provide a valid credit/debit card that you are authorised to use. In the event of damage, loss or late returns, the credit/debit card provided will be charged to recoup late return, damage or loss fees. Â
(ii) In the event of fees not being paid, The 105 reserves the right to take necessary legal steps to recover the cost.Â
(iii) The 105 currently uses the ‘Sum Up’ payment platform and all payments must be made upon reservation and collection from our showroom. The customer will receive receipts electronically.Â
9. Damage Protection Add On
(i) We completely understand that accidents may happen. In this instance, all minor damage is included in the hire price. However, excessive damage will incur an additional cost which will be dealt with on an individual basis.
(ii) Upon checkout, you will be given the option to add a €10 damage protection add on. This protection add-on covers you for up to €100 worth of damage of that item. The damage amount will be determined by our alterations/repairs team.Â
(iii) In the instance that the garment is deemed irreparable, this insurance does not apply and the customer shall be liable for the following:

- - Full replacement cost of the item
- – Loss of rental where applicable.
(iv) If you have not chosen to add the damage protection upon reservation of an item, we reserve the right to charge you any amount up to the RRP of the garment which shall be assessed on a case-by-case basis.Â
10. Online product description and Image Quality,
(i) We have made every effort to describe and display as accurately as possible online the style, material, colours and images of our products in stock in our showroom. We cannot guarantee that images will fully represent the item online.Â
(ii) All stock is constantly quality assessed for use of purpose.
11. Changes to terms of service
(i) Current Terms of service and conditions can be viewed at any time on our website.
(ii) We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service and Conditions on our website. Your continued use of or access to our website for our services following the posting of any changes to these Terms of Service and conditions, constitutes acceptance of those changes.Â
12. Privacy Policy
We would be delighted to invite feedback and testimonials of your experience renting from ‘The 105’ and with your prior consent, publish them on our social media platforms and/or on the review section on our website, and very much welcome your stories and photos. Â
